Guardianship (of adults) in Orlando and the surrounding area

Guardianship  of Adults in Orange County, FL ( Ninth Judicial Circuit of Florida ) Guardianship is a   legal relationship between a guardian and a ward . Instead of “ward,” y ou may sometimes hear the term “PUG,” standing for “person under guardianship.” This term never quite caught on (for rather obvious reasons), so you’ll hear the term “ward” more frequently than PUG.   The legal relationship between the guardian and ward is created by order of a court with proper jurisdiction , which in Florida is the Probate Court  for the judicial circuit in which the guardian ’s county of residence is located . While courts give preference to family guardians, corporations  and professional guardians can also  serve (see Florida Statute 393.12) ; all of these entities - family, professional, and corporate guardians - are subject to the same powers, duties ,  and responsibilities delineated in Florida Statutes chapter 744 or those defined by court order u...

Update! The Men's Rights Advocate Shows His True Colors

Image
Dude is nuts. Yesterday I posted a discussion about the differences between criminal prosecutions, civil cases, and university investigations into sexual assault allegations. It sprang from a common theme I see among the MRAs (men's rights activists): the claim that university investigations are de facto unfair because they don't allow the same constitutional protections set forth in the sixth amendment, like right to legal counsel and right to confront one's accuser. I pointed out that the sixth amendment only applies to criminal cases, and that college investigations (obviously) don't fall under that umbrella. I emphasized that the primary reason for beefed-up protections in the former kind of case is that the stakes are so much higher. Criminal convictions might result in jail/prison time; university investigations might result in expulsion at the worst (and only a fraction of a fraction of a fraction actually do, and one can file a civil suit if this happens...

College Sexual Assault Investigations Are Not Criminal Investigations

I recently encountered a post from a men's rights advocate (some of whom make good points, some of whom are downright creepy - if not abusive and dangerous) who was upset about the way in which colleges handle sexual assault allegations. I should note that this one was definitely in the former camp of MRAs bringing up reasonable points. In response to my noting that a tiny fraction of these cases actually result in any disciplinary action, and fewer still in expulsion, he wrote the following: " Not true at all, not a single one allows legal representation, not one allows the presentation of evidence or the ability to face and question their accuser. Maybe you should go actually look up the reality instead of spouting lies? The Responsibility of Law Enforcement in Public Discourse

Image
It appears now that it is impossible to discuss any topic of even the slightest relevance without expecting a wild backlash from random assholes carrying unduly strong opinions. One has a hard time concluding that it is wise to speak substantively about anything at all these days; the best course of action is to either remain silent or to ramble on about the banal and the unimportant, except in the company of the closest of friends and family who might be able to shoulder the weight of what has been threatening to burst out of you in the wrong places all week. The opportunity to unburden oneself of ideas has become a rare thing indeed, and every private interaction is a tacit confessional of matters that once fit comfortably in the public domain. After all, one never knows whether something that is said out loud will inadvertently trigger hazardous opprobrium from people who are suddenly ready to castrate your children (I don’t have children) and choke your dog ...
